Frequently Asked Questions About Estate Taxes & Estate Planning Q. I understand federal estate taxes can be higher than income tax rates, how high can they go? A. The estate tax rate on amounts in excess of $2 million is 46% for 2006. Q. Hasn’t the estate tax been repealed? A. Throughout American history the estate tax has been repealed and reenacted. It is currently scheduled to be repealed for one year only in 2010 and then return in 2011. Q. Can Congress change your will or estate plans? A. In terms of the actual document no, but changes in state or federal laws can have a dramatic affect on your plans. Q. How often should I review my estate plans? A. While this is an individual decision a growing number of people are making a practice of reviewing their estate plans annually to make sure that they are still up to date. Q. Can provisions be made in my will or estate plans for my favorite charitable trust? A. After providing for family and friends, many people derive personal satisfaction in making such gifts. For federal estate tax purposes there is no limit on the amount that can be left to qualified charities such as Conservation International. Q.
